By accessing or using the website personalguaranteeinsurance.com (the “Site”), operated by Braddock Road Insurance Corporation (“BRIC,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). These Terms incorporate by reference our Privacy Policy, Cookie Policy, and Accessibility Statement. If you do not agree to these Terms, you must not access or use the Site.
We reserve the right to modify these Terms at any time. Changes become effective upon posting to the Site with a revised “Last Updated” date. Your continued use of the Site after any modifications constitutes acceptance of the updated Terms. We encourage you to review these Terms periodically.
2. About Our Services
BRIC offers Personal Guarantee Insurance (“PGI”) designed to protect personal guarantors of Small Business Administration 7(a) loans. The Site provides general information about PGI, allows prospective applicants to check preliminary eligibility, and enables submission of applications for insurance coverage.
PGI is available in select states. Not all products and services described on the Site may be available in all jurisdictions. Coverage availability is subject to applicable state laws and regulatory requirements.
3. Not an Offer of Insurance
Nothing on this Site constitutes a binding offer, solicitation, or recommendation to purchase any insurance product. All information provided on this Site is for general informational purposes only. A binding insurance policy is issued only after completion of our full underwriting process, payment of the applicable premium, and issuance of a written policy by BRIC.
Preliminary eligibility results generated through the Site (including the “Do I Qualify?” tool) are estimates only and do not guarantee that coverage will be offered, nor do they represent a quote, binder, or commitment of any kind. Premium indications are subject to change based on underwriting review.
Any descriptions of insurance coverage on this Site are general summaries only. Actual coverage is subject to the terms, conditions, limitations, and exclusions set forth in the issued policy. In the event of a conflict between information on this Site and the terms of an issued policy, the policy terms shall govern.
4. Surplus Lines Insurance Disclosure
PGI is a surplus lines insurance product. Surplus lines insurance is placed with insurers that are not licensed (“admitted”) in the state where the insured risk is located. Important disclosures regarding surplus lines insurance include:
No Guaranty Fund Protection. Surplus lines policies are generally not covered by state insurance guaranty funds. In the event of insurer insolvency, policyholders may not have access to guaranty fund protections available for admitted insurance products.
Regulatory Oversight. Surplus lines insurers are subject to oversight by the state(s) in which they operate, but the nature and extent of that oversight may differ from the regulation of admitted insurers.
Taxes and Fees. Surplus lines policies may be subject to state surplus lines taxes and stamping fees, which may be in addition to the quoted premium. Applicable tax rates vary by state.
Surplus Lines Broker. Surplus lines insurance must be placed through a licensed surplus lines broker in accordance with applicable state law. Additional state-specific disclosures may apply and will be provided with your policy documents.
5. Geographic Availability and Compliance
The Site and our insurance products are intended solely for use by individuals and businesses located in the United States. BRIC makes no representation that the materials on this Site are appropriate or available for use in locations outside the United States. Users who access the Site from outside the United States do so at their own risk and are responsible for compliance with applicable local laws.
PGI is currently available in select states. Availability of coverage in your state is subject to applicable regulatory approvals and surplus lines filing requirements. Users are responsible for compliance with all applicable federal, state, and local laws and regulations when using this Site.
6. Eligibility and Use Restrictions
By using the Site, you represent and warrant that:
(a) You are at least 18 years of age;
(b) You have the legal capacity to enter into binding agreements;
(c) All information you provide through the Site is accurate, current, and complete;
(d) You will not use the Site for any unlawful purpose or in violation of these Terms; and
(e) You will not use the Site to submit fraudulent applications or misrepresent material facts.
7. Prohibited Uses
In addition to the restrictions above, you agree not to:
(a) Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Site without our express written permission;
(b) Use the Site in any manner that could disable, overburden, damage, or impair the Site or interfere with any other party’s use;

(d) Attempt to gain unauthorized access to any portion of the Site, other accounts, computer systems, or networks connected to the Site;

8. Application Process and Accuracy of Information
If you submit an application for PGI coverage through the Site, you agree to provide truthful, accurate, and complete information. Material misrepresentation or omission of facts in an application may result in denial of coverage, rescission of a policy, or denial of claims.
We reserve the right to verify any information you provide and to request additional documentation as part of our underwriting process. Submission of an application does not obligate BRIC to issue a policy.
9. Intellectual Property
All content on the Site, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, is the property of BRIC or its licensors and is protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.
“Personal Guarantee Insurance,” “PGI,” and the BRIC logo are trademarks of Braddock Road Insurance Corporation. Unauthorized use of our trademarks is strictly prohibited. You may download or print material from the Site for your own personal, non-commercial use only, provided you do not modify the materials and retain all copyright and proprietary notices.
10. Third-Party Links and Services
The Site may contain links to third-party websites or services, including but not limited to HubSpot (for form submissions and CRM), payment processing services, and analytics providers. These third-party services are governed by their own terms of service and privacy policies. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BRIC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SITE, REGARDLESS OF THE THEORY OF LIABILITY.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SITE EXCEED ONE HUNDRED DOLLARS ($100.00). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

14. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be resolved exclusively in the state or federal courts located in the State of Delaware, and you consent to the personal jurisdiction of such courts.
15. Termination
We reserve the right to suspend or terminate your access to the Site at any time, without prior notice, for any reason, including but not limited to a breach of these Terms. Upon termination, all provisions of these Terms that by their nature should survive termination shall survive, including without limitation ownership provisions, warranty disclaimers, indemnification, and limitations of liability.
16. Severability and Waiver
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or any other term. Our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
17. Entire Agreement
These Terms, together with our Privacy Policy, Cookie Policy, and Accessibility Statement, constitute the entire agreement between you and BRIC with respect to your use of the Site and supersede all prior or contemporaneous agreements, communications, and proposals, whether oral or written.
